Terms of Service

1. About Mali

Mali is a personal finance education and literacy application ("the App") operated by Britz Ventures (Pty) Ltd (Registration: 2023/604769/07), a company registered in the Republic of South Africa ("we", "us", "our").

Mali provides financial education tools including bank statement analysis, spending categorisation, budget tracking, goal setting, and AI-powered financial literacy features. Mali does not provide financial advice, credit, insurance, or any regulated financial services. All information presented in the App is for educational and informational purposes only.

2. Acceptance of Terms

By creating an account and using Mali, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not create an account or use the App. We reserve the right to update these terms at any time. If material changes are made, you will be asked to re-accept the updated terms before continuing to use the App.

3. Eligibility

You must be at least 18 years old and a resident of South Africa to use Mali. By creating an account, you confirm that you meet these requirements and that the information you provide is accurate and complete.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Bank Statement Data

Mali allows you to upload bank statement PDFs for analysis. By uploading a bank statement, you confirm that:

• The bank statement belongs to you or you are authorised to share it
• You consent to Mali processing the data contained in the statement for the purpose of providing financial education tools
• You understand that Mali categorises transactions using AI technology, which may occasionally make errors
• You can correct any miscategorised transactions within the App

Bank statement data is processed securely, stored only for your account, and is never shared with third parties for marketing, advertising, or any purpose other than providing you with the App's features. You can delete your data at any time from your profile settings.

6. AI-Powered Features

Mali uses artificial intelligence to analyse your financial data, categorise transactions, generate budgets, and provide educational insights. You acknowledge that:

• AI-generated content is for educational purposes only and may contain errors
• AI categorisation of transactions may not always be accurate
• Budget suggestions are based on your historical spending data and general benchmarks — they are not personalised financial advice
• You should verify important financial information independently
• Mali's AI persona ("Mali") is a software feature, not a qualified financial advisor

7. Not Financial Advice

Mali is a financial education and literacy tool. It does not provide financial advice as defined by the Financial Advisory and Intermediary Services Act (FAIS), 2002. Nothing in the App should be construed as a recommendation to buy, sell, hold, or otherwise deal in any financial product. For personalised financial advice, consult a registered financial advisor authorised by the Financial Sector Conduct Authority (FSCA).

8. Fees and Subscription

Mali offers free and paid subscription tiers. Free features may be limited in scope. Paid subscription fees, features, and payment terms will be clearly communicated before purchase. Subscription fees are billed in South African Rand (ZAR). We reserve the right to change pricing with reasonable notice.

9. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, software, and the Mali AI persona — are the property of Britz Ventures (Pty) Ltd and are protected by South African and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our written consent.

10. Limitation of Liability

To the maximum extent permitted by South African law:

• Mali is provided "as is" without warranties of any kind, express or implied
• We do not guarantee that the App will be error-free, uninterrupted, or free of viruses
• We are not liable for any financial decisions you make based on information provided by the App
• We are not liable for any loss or damage arising from the use of AI-generated content
• Our total liability to you shall not exceed the fees paid by you in the 12 months preceding the claim

11. Account Deletion

You may delete your account and all associated data at any time from the Profile section of the App. Upon deletion, all your personal information, bank statement data, transaction records, goals, and budget data will be permanently removed. This action cannot be undone.

12. Termination

We reserve the right to suspend or terminate your account if you violate these terms, use the App for unlawful purposes, or engage in behaviour that we reasonably consider harmful to other users or to our business. In the event of termination, you may request a copy of your data in accordance with your rights under POPIA.

13. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or the use of the App shall be subject to the jurisdiction of the South African courts.
